Your girlfriend should be able to place a claim against the at fault person's insurance even though she was uninsured at the tine of the accident. However, if your girlfriend was cited for driving without insurance she will be facing penalties per Missouri state law. Chapter 303 of the Missouri Revised Code is about the Motor Vehicle Financial Responsibility Law. Here it states that not maintaining financial responsibility on your registered vehicle is guilty of a class C misdemeanor.
It continues on saying that n addition to any other authorized punishment, the court shall notify the director of revenue of any person convicted pursuant to this section and shall do one of the following:
(1) Enter an order suspending the driving privilege as of the date of the court order. If the court orders the suspension of the driving privilege, the court shall require the defendant to surrender to it any driver's license then held by such person. The court shall forward to the director of revenue the order of suspension of driving privilege and any license surrendered within ten days;
(2) Forward the record of the conviction for an assessment of four points. The court will send the conviction to the Missouri Driver and Vehicle Services Bureau and it will be entered on the person's driving record along with 4 points; or
(3) In lieu of an assessment of points, render an order of supervision. In this case the Driver and Vehicle Services Bureau will monitor the driver to ensure auto liability insurance is being maintained. An order of supervision shall not be used in lieu of points more than one time in any thirty-six-month period.
