I was in a accident police report illustration does not match actual point of collision on both cars, is that legal and can they still use police report in evidence?

The police report and illustration is only representative of the information the officer was given and/or saw. If it is mistaken then you should bring this to the attention of the insurance company or court if this collision has caused a lawsuit against you.

While an insurance company will look at the illustration and police report they will also get statements from you and other drivers involved and do their own investigation into the collision to determine fault. They should also be able to determine the point of collision on the vehicles by looking at the cars involved in the wreck.

If this is going to be a lawsuit decided in court then the police report illustration could likely be used as evidence but with pictures of the actual damage and point of collision then you would likely be able to prove the illustration to be incorrect. A lawyer familiar with your state's laws could give you more information on this topic.
