An illegal nanny was driving her boss' car, ran a stop sign and hit me. Damage to my car was $3,000. Both she and her boss begged me not to call police and offered to pay all car damages so there is no police report. I have NJ no-fault insurance and GAVE UP right to sue to get the lower premium. If we do not go through insurance, can I sue her in court, for damage and bodily injury regardless of my no-sue insurance?

According to the New Jersey Department of Banking and Insurance (NJ DOBI) auto insurance buyer's guide the unlimited right to sue and limited right to sue options only cover lawsuits for “pain and suffering” or non-economic losses. Your medical expenses and some economic losses for injuries in auto accidents will be paid up to the limits of your PIP coverage and are not affected by the choice you make here.

If the other party is not going to pay for the car's damages personally or through their insurance company then you may want to use your own collision coverage or see about a lawsuit against the driver and/or owner of the car.
