Car Insurance Question  My husband and I were in a accident recently. It was the other driver's fault. We do not have insurance but he does. He has liability. What does liability cover? Does it cover hospital bills because I was injured though my husband was not.

It will depend upon state laws if you can place a claim against the at-fault party's insurance since you and your husband were driving without insurance. In most states you can place a claim against the other person's insurance policy though there are states which have restrictions against claims if you were without insurance at the time of the accident. For example Louisiana has a "no pay no play" law which states you cannot put in a claim for the first $10,000 worth of property damages or bodily injuries.

Liability coverages also change depending upon state law requirements and the terms of the person's policy. If you are in a state that requires a person to carry property damage and bodily liability and that allows an uninsured motorist to make a claim against the at fault party then normally you could place a claim for the damages to your car and for your injuries.

Property damage liability covers a person their car damages someone else's property. Bodily injury liability covers bodily injuries or death for which the policyholder is responsible for. Claims for bodily injury may be for such things as medical bills, loss of income or pain and suffering. Coverage for both types of liability is limited to the terms and conditions contained in the person's policy.

In you are in a no fault state though, that requires property damage and personal injury protection (PIP) you can put your car's damages claim in with the at fault party but your injuries would normally need to go through your own auto insurance's PIP coverage. Without having this required insurance you would likely be responsible for your own medical bills.
