I was recently in an accident. There was a heavy fog, you could only see about 2 car lengths. I rear ended a car. She had stopped in a curve to make a left hand turn. This was at 7 am, it was still relatively dark also, she did not have her lights on, her brake lights didn't work, and she didn't have her blinker on. Am I still at fault?

This accident should be investigated by the insurance companies involved and fault determined based on driver statements and the state negligence laws. If you have witness statements and a police report these documents may also help determine fault.

If the other party has stated that she did not have her lights or blinker on and that her brakes lights did not work it could help your case that in the heavy fog that this accident was at least in part her fault.

Report the accident to your insurance agent and see what he or she can tell you about your state's negligence laws, whether they are comparative or contributory. Once the accident is investigated by the claims adjuster they should be able to tell you if fault will be placed on you, the other party or both of you.
