I just received a speeding ticket in the state of Florida and I am a Delaware resident. I was wondering what my options may be. Do the points show up on my Delaware License? What if I just avoid making payment, would the points never get to Delaware since I never made payment (did not admit guilt)? I do know that Florida offers driving school to avoid points, but Delaware does not. Is there any way to honestly and legally get away with not have any points applied to my Delaware license other than fighting it in Florida courts?

Delaware and Florida are both part of the Drivers License Compact (DLC). Members of this agreement are required to report tickets received by motorists back to the state where the driver is licensed. This means that the Florida court should report to the Delaware Division of Motor Vehicles this speeding ticket once you are convicted of it in FL.

The Delaware Code of law lists the Drivers License Compact under Chapter 81 of Title 21, the Motor Vehicle section. This section unfortunately does not make it clear if points will be assigned once the out of state violation is reported to the DMV. If it is, it would likely receive the same amount of points as if the offense occurred in state.

Florida and Delaware are also members of the Non-Residents Violator Compact (NRVC). The Non-Resident Violator Compact requires member states to suspend the drivers license of those who get traffic tickets for moving violations in other states and fail to pay them.

So if you try to avoid the Florida speeding ticket from being placed on your Delaware driving record and being assigned points by not paying the ticket the DE DMV will likely suspend your license for not taking care of the out of state ticket.

To see if traffic school or a driving course is available to you as an out of state licensed driver check with the court listed on your traffic ticket. You may also see if the ticket can be reduced to a different violation that would not be reported back to Delaware. If you wish to fight the ticket you may wish to find a FL lawyer that works with this type of case.

Florida traffic schools state that if you an out of state license you should contact the Department of Highway Safety or DMV in your home state before signing up for FL traffic school to verify that the withholding of points will be honored in your state.
