I received two tickets in Indiana (Jackson county) and am a resident of Illinois. If I pay the tickets, will they go on my record or am I eligible for supervision? The tickets do not have any information on them. I called the court and they do not have a straight answer either.

Indiana is part the Drivers License Compact (DLC), as is your home state of Illinois. Due to being part of the DLC Indiana courts will advise the Illinois Secretary of State (SOS) once you are convicted of these two traffic tickets.

The drivers section of the IL Secretary of State site does not mention specifically that out of state tickets are put on your driving record. However the Illinois Administrative Code Motor Vehicle section 1040.20 gives information on the Illinois offense table. Here it notes that all out-of-state convictions are to be considered and to be coded exactly as Illinois Vehicle Code violations with the exception of the first digit which shall be an “8.”

From this Administrative Code information listed above we gather that out of state moving violations will be added to your Illinois driving record and assigned points.

A new law enacted on January 1, 2006 limits Illinois drivers to two court supervisions for moving violations in a 12-month period. Any other moving violations of which a driver is found guilty during that period would result in convictions reported to the individual's permanent driving record.

In Illinois if a judge grants a driver court supervision for an offense, the driver is not subject to the mandatory penalties of the conviction; the judge determines the penalties. Judges are prohibited from granting court supervision to a driver more than once in a lifetime for a DUI offense, and then only if there was no previous conviction. Because the Secretary of State's office records all court supervisions, repeat offenders are more easily identified, enabling judges to impose appropriate penalties.

Since this court supervision process must be granted by an IL judge it would not appear that it would be available to you for your Indiana traffic offenses. You likely instead need to speak with the IN clerk of the court to find out if there is traffic school or any other option you are eligible for in Indiana that would keep these citations from being reported to Illinois and being placed on your driving record there.
