The Ministry of Transportation (MTO) notes is a safety belt fact sheet that effective December 1, 2006, in Ontario, every person traveling in a motor vehicle must wear a seat belt or use a child safety seat. It goes on to state that convicted offenders will receive two demerit points.
The MTO notes that the driver is responsible to ensure all passengers under 16 years of age are properly restrained. If a child is under 23kg (50lbs) he/she must occupy a seat fitted with a seat belt when available. So a driver can be cited if passengers such as mentioned here are not safely and correctly buckled in.
The MTO fact sheet does not state that the points are only for drivers however the demerit points lists only lists 2 points for drivers that fail to wear a seat belt and does not mention points for passengers.
I would recommend to check with the MTO to find out for certain to find out if demerit points can be assigned to a passenger that received seat belt citation. As a G1 licensed driver in Ontario if you get two or more demerit points, you will be sent a warning letter.
The fine for not wearing an appropriate restraint system, or not wearing it correctly, is $60 to $500 normally in Ontario. For more information on Ontario's seat belt laws, see section 106 and regulation 613 of the Highway Traffic Act.
