Car Insurance Question  I got ticketed for doing 85 in a 55 in NYS and I have a NYS driver's license, will my license be taken away or what exactly is gonna happen to me?

To find out your exact penalties for being cited for speeding 30 mph over the posted speed limit you will need to call the traffic court listed on the ticket.

The New York Department of Motor Vehicles states that speeding between 21 and 30 miles per hour over the speed limit is 6 points on your driving record. In NYS the DMV computer system automatically calculates your point total. Your point total is the total number of driver violation points that you received during the 18 previous months. The points are counted from the dates of your traffic violations, not from the dates of your traffic convictions. A traffic conviction is required for the points to appear on your driver record.

Whether this speeding ticket will affect your license will likely depend on your driving record. If you have previous violations and points on it then this addition of 6 points may cause your point total to reach the point which a suspension could occur.

If you receive 11 points or more in 18 months, the DMV suspends your driver license. You cannot request a DMV hearing to request a waiver of the suspension.

In addition to any fines, fees, penalties, or surcharges that you pay for a traffic conviction, you must pay the driver responsibility assessment in certain situations. The assessment is an amount that you must pay each year for three years. You pay the assessment to the DMV if you are notified that you owe it by receiving a statement in the mail from the DMV.

You must pay the driver responsibility assessment if you receive six or more points on your NYS driver record during a period of 18 months and the violations occurred on or after November 18, 2004 according to the NYS DMV.

For receiving 6 points within 18 months the annual assessment is $100. The minimum amount that you must pay each year is the annual assessment. The total assessment for the three years is $300.

If you receive more than six points on your driver record during a period of 18 months, the annual assessment is $25 for each point more than the original six points. The minimum amount that you must pay each year is the annual assessment. The total assessment for the three years is $75 for each point more than the original six points.
