I am from South Carolina but got a ticket in Georgia for going 22 over the posted speed limit. What will happen to my insurance if I plead nolo?

Your home state of South Carolina is part of the Driver's License Compact (DLC) while Georgia is not. Even though Georgia is not a member of the Drivers License Compact that requires states to transfer ticket information back to the state in which a person is licensed, the GA DMV has decided to still report convictions of moving violations back the home state of a person with an out of state license and receive in information regarding tickets drivers received out of state.

According to the South Carolina code of law states that convictions for out of state moving violations that would be a violation according to SC statutes may be recorded against the driver. Since this is a speeding ticket there should be a like offense in SC that will be put on your driving record. To find out how this out of state ticket will be recorded and if points will be assessed, contact the South Carolina Department of Motor Vehicles

If you plead guilty or nolo contendere in GA for this speeding citation it would appear that SC would be informed of your conviction for a speeding violation and place it on your SC driving record. You can check with the SC DMV to find out for certain if this or other penalties will be assigned to your SC driver's license if you plea NOLO for your Georgia speeding violation.

Since this SC violation will likely show up on your SC driving record, your insurance company could see it next time they pull your MVR. According to the South Carolina Department of Insurance, all insurance companies use a uniform merit rating system for auto insurance purposes. It is based on convictions for moving violations and/or accidents.

The first point assigned to each vehicle eliminates the safe driver discount. Each point in excess of one has an annual surcharge of $20 for liability and $20 for collision. The merit rating system is different than the DMVs driver license points so check with the SC DOI to get more information on this merit points system and see if your will get a point assigned for our the out of state move over violation.
