What is the penalty for being unlicensed and driving in Hawaii?

According to the Hawaii Revised Statutes, section 286-102, no person shall operate any category of motor vehicles listed in this section without first being appropriately examined and duly licensed as a qualified driver of that category of motor vehicles.

The penalties for driving without a valid license that the Hawaii laws require is listed in HRS 286-136. Here it states that the penalty for violating section 286-102 (and other sections of the Hawaii statutes governing licensing issues) shall be fined not more than $1,000 or imprisoned not more than thirty days, or both. Any person who violates any other section in this part shall be fined not more than $1,000.

This HI statute goes on to say that any person who is convicted shall be subject to a minimum fine of $500 and a maximum fine of $1,000, or imprisoned not more than one year, or both, if the person has two or more prior convictions for the same offense in the preceding five-year period.

And that a minor under the age of eighteen under the jurisdiction of the family court who is subject to this section shall either lose the right to drive a motor vehicle until the age of eighteen or be subject to a fine of $500.

If you were cited for driving without a license then you should call the court listed on your ticket to find out if you will need to attend court to take care of this issue and the exact penalties you may be facing. The HI Department of Motor Vehicles may also be able to give you information on this offense and if you will be able to get a valid license if convicted.
