What will happen to me if I was caught driving with my friend and I have my learner's permit? I am 15 yrs old and got my permit 10 months ago. The state I live in is Florida.

Florida statute 322.1615 pertains to the learner's driver's license. Here it states under subsection 2 that when operating a motor vehicle, the holder of a learner's driver's license must be accompanied at all times by a driver who:

  • Holds a valid license to operate the type of vehicle being operated;
  • Is at least 21 years of age; and
  • Occupies the closest seat to the right of the driver of the motor vehicle.

And subsection 3 states that a person who holds a learner's driver's license may operate a vehicle only during daylight hours, except that the holder of a learner's driver's license may operate a vehicle until 10 p.m. after 3 months following the issuance of the learner's driver's license.

Furthermore, a licensee who violates subsection (2) or subsection (3) is subject to the civil penalty imposed for a moving violation and fined in accordance with chapter 318.

You can read through the Florida statutes regarding a FL learner's license or permit to get more information on the penalties for breaking a restriction or contact the Florida Department of Highway Safety and Motor Vehicles (HSMV) for the exact penalty courts normally hand out in this situation.
