Car Insurance Question  I recently had a bad day in which I received a $25 ticket in Indiana for not wearing my seat belt and later a $110 ticket in Ohio for going "14" over the speed limit. My question is will either of these transfer to Virginia where my license is from? Will these increase my insurance rates at all? I have one previous ticket from West Virginia however my insurance did not increase from that so I don't think West Virginia told real Virginia about it, can I expect the same from Indiana and Ohio?

Your home state of Virginia along with Ohio, Indiana and even West Virginia are part of the Drivers License Compact (DLC).

The DLC requires member states to report out of state tickets received (and that you are convicted of) back to the state in which the driver is licensed in. So both Indiana and Ohio should report your traffic violation convictions back to Virginia. Once Virginia has received this information from IN and OH, the VA DMV asserts that they will assign demerit points to your driving record for traffic convictions incurred in other states.

Since the Virginia Department of Motor Vehicles states that demerit points can be assigned to your driving record for traffic convictions occurring out of state you can check their site or the read through the VA driver’s handbook to find out the amount of points that these types of offenses may be assessed.

Virginia law requires drivers and front seat passengers to wear safety belts and to ensure that children under age 16 are properly restrained. So since Virginia also has a seat belt law then likely your citation for a seat belt infraction in Indiana will be placed on your VA record.

From our research it would appear that in VA that a safety belt violation usually is a fine only but in Virginia points for speeding violations are allocated as follows:

  • 3 points - Speeding 1-9 mph above the posted speed limit
  • 4 points - Speeding 10-19 mph above the posted speed limit
  • 6 points - Speeding 20 mph or more above the posted speed limit and is considered reckless driving.

Once the IN and OH violations are placed on your VA driving record, your insurance company could see the offense and thus cause your rates to rise. Virginia allows insurance companies to assign points on your insurance record but these point values are developed by individual insurance companies so you will have to contact your provider to see if this out of state speeding ticket and seat belt will affect your premium.

As for your previous out of state offense in West Virginia. It could be that WV courts did not get around to informing the VA DMV about that moving violation. Or it could be on your VA driving record but your insurance company's rating system is as such that it did not cause your rates to rise. To find out if the WV citation made it to your VA driver's history, get a copy of your MVR from the VA DMV.
