Car Insurance Question  I have an ongoing case on a DUI in Massachusetts where I resided previously. I recently moved to Georgia and was wondering if I can get a license here by denying that I have ever had a license. Could I get a driver's license there if I go through the whole process?

We would never recommend giving fraudulent information on a driver's license application in Georgia or any other state. It is illegal to give false information when applying for a license, which it would be if you deny being previously licensed.

The Georgia Department of Driver Services (DDS) has a mandatory suspension of a license for a conviction of any of the following offense in Georgia or any other state: Fraudulent or fictitious use of, or application for a license.

GA Driver Manual states that the Department of Driver Services is authorized to cancel your license if you fail to give the required or correct information needed in your apĀ­plication or if you are otherwise ineligible. You may reapply once you satisfy the requirements.

Also keep in mind that all states check the Problem Driver Pointer System (PDPS) and/or National Driver Register (NDR) to see if a driver's license applicant is listed.

The PDPS helps search the NDR which is a central database of information on problem drivers (those whose license has been revoked, suspended, canceled or denied or have been convicted of serious traffic related offenses) provided by all 51 US jurisdictions.

Based on information received as a result of an NDR search, PDPS will "point" the inquiring jurisdiction to the State of Record, where an individual's driver status and history information is stored. The PDPS is intended to assist jurisdictions in the meeting the basic tenet that has been in the works of the US that "each driver, nationwide, have only one driver license and one record."

If you do not inform Georgia of your Massachusetts licensing issues (which is sounds as if you have because of the DUI) they should find out by check out the NDR and thus turn down your license application or revoke your GA license if it was somehow already issued.

You may want to contact the Georgia DDS and discuss your MA situation to see if with the DUI issues that are pending you can obtain a GA license or not. If your MA license is currently suspended GA will likely require you to have it reinstated before allowing you a license but get specific information from this state licensing agency.
