I was issued a ticket in Montreal for going in excess of 160 kilometers/hr. I live in New York, so is there any way that the points issued to me in Quebec will be issued to me in NY.

Yes, you are likely to get points added to your New York driving record for this speeding violation in Montreal, Quebec. Quebec and New York State have a reciprocal agreement to share information concerning driver's license and traffic offenses between the province and the state.

The New York Department of Motor Vehicle states that they do not record out-of-state violations committed by NYS drivers in other jurisdictions. The exceptions are alcohol-related violations, drug-related violations, and moving violations committed in Quebec or Ontario.

Under special agreements, traffic convictions in Quebec or Ontario are recorded on NYS driver license records and carry points. Except for violations in Ontario and Quebec, points are not added to your NYS record for out-of-state violations.

Speeding tickets vary in points in NY from 3 to 11 points depending upon the amount of miles per hour over the speed limit you were cited for. Since 160 kilometers/hour roughly converts to around 100 mph the amount of points you receive may be pretty high, once again depending upon the posted speed limit in the area you were ticketed.

If you were a resident of Montreal demerit points for speeding are assessed from 1 to 15 depending upon the km/h the speed you were in excess of limit prescribed.

The reciprocal agreement for these 2 areas is an Application of the Highway Safety Code (R.S.Q., c. C-24.2) to the holder of a driver's licence issued by the Société de l'assurance automobile du Québec (SAAQ) or by the Department of Motor Vehicles of the State of New York.

The reciprocal agreement between the state of New York and Quebec concerning driver's licenses and traffic offenses was made for various reasons including to:

  • Promote compliance with traffic laws and improve highway safety within their own borders;
  • Further highway safety by treating offenses for which their residents have been declared guilty in the other jurisdiction, as if they had been committed in the home jurisdiction for the purposes of updating and maintaining driver's license records;
  • Strengthen cooperation between the 2 jurisdictions so that residents satisfy fines imposed as a result of offenses committed within the other jurisdiction and for which they have been found guilty;
  • Allow motorists to accept traffic citations for certain offenses and proceed on their way without delay.

The agreement between NYS and Quebec allows that whenever a resident of the other jurisdiction has failed, following a declaration of guilt, to pay a fine imposed as a result thereof, within 30 days, the jurisdiction in which the ticket was issued shall notify the home jurisdiction of such failure.

Upon receipt of the notification the home jurisdiction shall inform the driver that his driving privileges are or will be suspended in the other jurisdiction pending compliance with the terms of the citation.
