Car Insurance Question  Is auto deductible refundable if claimant is not at fault?

It depends on the coverage and situation. Typically no, your deductible is not normally refunded to you if you are not at fault in an accident, but it can be refunded by the at-fault party's insurance company.

The deductible for your collision or comprehensive (physical damages) coverages is usually due no matter if you are at fault or not at fault in the incident that caused the damage which you are making a claim on.

It may be possible to be reimbursed for your deductible though if you are found not at fault and your insurance company then goes after the at fault party to recover the monies paid out for the damages they caused.

If your insurance provider will surbrogate with the person that caused the accident (or their insurance company) then you can discuss with your insurance agent or insurance adjuster the possibility of them also recouping our deductible amount so that it could be returned to you.
