Car Insurance Question  To which insurance company do I file under if the wreck was not my fault?

In most states if you were hit by another person in an accident you are able to put a claim for your damages through the at fault party's liability insurance coverages.

For damages your vehicle sustained it would normally go through the at fault person's property damage portion of their policy.

If for some reason you have trouble putting a claim through the at fault person's insurance then you could instead put the claim through your own collision coverage though your deductible would be due. You could discuss with your agent though to see if they plan on subrogating with the at fault party's insurer for the claim and see if they would also be able to get your deductible amount back as well.
