An adult that I know frequently drives her husband's cars without a license. She does not have, or has ever had, a license to drive in any state. She never took the tests. She drives her children around, and it makes me very upset that a false driver has gotten away with this for almost 20 years. What are the penalties under Maryland law for driving without a license (or ever having one) and without insurance? I want to report her, but I don't want her children to lose their mother.

Driving without a license in Maryland is a misdemeanor. The normal penalty, according to several sources, in Maryland for driving without a license (and never having one) is a $315 fine and no jail time

In 2006 legislation was introduced that would require people charged with driving without a license to appear in court and face penalties that would include 90 days in jail for a first offense and up to a year in jail for a second offense. We cannot find that this legislature has gone any farther then being a house bill thus far. However you may want to double check with MD Motor Vehicle Administration (MVA) to see if this if any new driver licensing laws have been passed that would include imprisonment or harsher penalties then a fine.

MD Transportation Code section 16-101 is the statute law that is written in regards to drivers licenses. Here it states that drivers must be licensed. Section (a) states that an individual may not drive or attempt to drive a motor vehicle on any highway in this State unless:

(1) The individual holds a driver’s license issued under this title:

(2) The individual is expressly exempt from the licensing requirements of this title; or

(3) The individual otherwise is specifically authorized by this title to drive vehicles of the class that the individual is driving or attempting to drive.

Driving while not licensed is a 5 point offense as well according to the MVA. A driving record can be started for person even if they have never obtained a valid driver's license.

Driving without insurance in MD having penalties that include: loss of license plates and vehicle registration privileges, pay a restoration fee of up to $25 for a vehicle's registration, be prohibited from registering any future vehicles until all insurance violations are cleared, have license plates confiscated by an authorized tag recovery agent, once registration suspension is in effect and pay a fine of up to $1,000 and/or 1 year imprisonment if provided false evidence of insurance.

If you report her to the MVA or law enforcement they may be able to tell you more about the penalties she would received if cited for driving without a license and without insurance since it would appear her husband's insurance would not cover her due to her being unlicensed.
