I have liability coverage and was just involved in an accident and I am not at fault. The other person was at fault but he is not a licensed driver. The vehicle he was driving is insured by the owner of the vehicle. Will the insurance of the owner of the vehicle cover my damages?

Insurance policy terms differ however normally the owner's insurance would cover the driver if he gave permission to the driver to operate the vehicle. Insurance typically follows a car first and driver second so the owner's policy would be primary even if the driver was licensed and had their own insurance.

Some insurance policies may have exclusions though for a person driving on a suspended or otherwise invalid license or if they are an unlicensed driver.

To find out if the insurance of the owner of the car that was at fault in the accident will accept your claim for the damages you sustained you will need to contact them and try to place a claim. If the claim is not accepted their insurance adjuster should be able to tell you and the reason why it is denied.

If the claim is not accepted then you may want to get legal advice on who you can take to court, the driver and/or owner of the car, so to try and get a judgment against them for the cost of the repairs to your vehicle.
