I recently drove my mother's car (with a friend in the car), without a license (I'm 16), and my dad found out and called the police to turn me in. I am wondering what I could possibly be charged with, what the insurance and longer-term effects would be, as well as the legal issues. The Missouri law states that this is a Class A Misdemeanor, and I want to know what that means, as well as if I can get it lowered to an infraction.

Driving without a license is what you were likely likely cited for and as you mentioned this is a Class A misdemeanor in Missouri.

According to Missouri Revised Statutes (Section 557), offenses are broken down and classified into the following categories, ranked from most serious to least serious:

  • Felonies- Class A, Class B, Class C, Class D
  • Misdemeanors - Class A, Class B, Class C
  • Infractions

So a Class A Misdemeanor is considered a fairly serious offense. A Missouri Class A misdemeanor comes with maximum penalties of up to 1 year in jail and a fine of up to $1000. Infractions usually have no imprisonment penalty but can come with fines of up to $200.

This offense will be placed on your driving record. The state of Missouri can start a driving record for you, probably using your social security number, even though you are not licensed yet.

Operating without a valid license in violation section 302.020 of MO law and a first offense has 2 points added to your driving record. Also if someone like your mother knowingly allowed you, an unlicensed driver, to operate a vehicle they will have this offense placed on their driving record and be assessed 4 points.

To find out what exactly you an or will be charged with you may want to contact the court listed on any citation you may have received and or contact a lawyer familiar with this type of law in Missouri. A lawyer would also be able to advise you if it will be possible to get this misdemeanor charge lowered to an infraction.
