Car Insurance Question  How much coverage is REQUIRED by the state of CT for the underinsured?

Connecticut law requires that all registered motor vehicles have liability insurance. Insurance must be maintained at all times when there is an active registration entitling the vehicle to be operated on the public highway.

Limits of liability as required by law are as follows:

  • $20,000 bodily injury per person.
  • $40,000 bodily injury per accident.
  • $10,000 property damage per accident AND
  • Combined $20,000/$40,000 of Uninsured/Underinsured Motorists Bodily Injury is also required.

In some states you are required to have just Uninsured Motorists Bodily Injury, in other states you are required to have Uninsured/Underinsured Motorists Bodily Injury, and in other states you are required to have Uninsured Motorists Bodily Injury, but Underinsured Motorists Bodily Injury is optional or not available. Connecticut requires the combined Uninsured/Underinsured Motorists Bodily Injury coverage.

In Connecticut, Uninsured Motorists Bodily Injury must be sold at the same limits as Bodily Injury Liability; however, you may purchase additional optional coverage up to an amount double the Bodily Injury Liability coverage.

Uninsured Motorists Bodily Injury covers bodily injury to you, your relatives who live with you and your passengers if they are injured in an accident caused by an uninsured motorist, or a hit-and run driver.

Underinsured Motorists Bodily Injury covers bodily injury to you, your relatives who live with you and your passengers if they are injured in an accident caused by a motorist whose bodily injury limits are less than your underinsured motorists bodily injury limits and whose bodily injury limits are not sufficient to pay for the damages you are legally entitled to recover.

This coverage is required under all vehicle liability policies insuring the owner of a motor vehicle. If this coverage is purchased on one vehicle on a policy, it must be purchased on all vehicles on the policy insured for liability coverage.

The CT Insurance Department (CID) confirmed to us that the minimum amount required by law is $20,000 per person, $40,000 per accident and stated that Uninsured/Underinsured Motorist coverage is mandatory in the state of Connecticut. The representative said to contact the CID at 860-297-3853 if you have more questions regarding the issue of uninsured/underinsured motorist coverage required in CT.

Some drivers are confused in Connecticut by optional Underinsured Motorist “Conversion."Underinsured motorists conversion also provides for reimbursement in case you are injured by an underinsured driver. If your damages exceed the at-fault driver’s insurance, or other payments, your customer’s underinsured motorists conversion will be available for damages not paid.

This optional coverage is not reduced by payments from any other source, including the at-fault driver’s liability insurance. You may purchase underinsured motorists conversion coverage up to an amount double the bodily injury liability.

Section 38a-336 of Connecticut General Statutes speaks about Uninsured and Underinsured Motorist coverages for CT if you would like to research the state laws concerning this topic.
