Car Insurance Question  I have driven on my provisional license for 1 year. I turned 18, 3 weeks ago and have yet to get my basic license. I have no violations. Should I get pulled over at this time (being 18, with a provisional license) would I still be subject to the same limitations as my provisional license? This is in the State of New Jersey.

You should check with the New Jersey Motor Vehicle Commission to be certain but from our understanding of how the Graduated Driver's License (GDL) process works in NJ we believe that yes, you would be subject to the same limitations as your provisional license list since you are still in possession of that license instead of a full basic driver's license. Provisional driver license restrictions in New Jersey include:

  • No driving between 12:01 a.m. and 5:00 a.m.
  • Passengers must be from your household. Only one additional person from outside your household is allowed in the vehicle.
  • If you are at least 21 years old, there are no passenger or hour restrictions.
  • You cannot use cell phones, hand held video games or any other hand held electronic device.

Since you are not yet 21 it appears that the provisional license restrictions for passengers and hours which you cannot drive are still in effect as is the condition that you cannot use handheld electrical devices, including a cell phone.

With a provisional license you need to practice driving for at least one year, which you can do unsupervised as long as you follow the restrictions.

To get a basic driver’s license:

  • You must be at least 18 years old
  • Complete the unsupervised driving period
  • Go to any MVC Agency with your provisional license and other documents to pass the 6 point ID and address verification, and
  • Pay $24 license fee

A provisional license is some states converts to a full driver's license in some states once you have turned 18 and completed other requirements however that does not seem to be the case in New Jersey. A provisional license can be held until you are 21 years of age or even older.
