My daughter lives in NJ. She is 17 years old with a provisional license. She was recently written up for speeding 47 in a 35 mph zone. This is her first offense. What will the repercussion be on her obtaining her basic license? Will she be able to get it within the year?

For speeding 12 mph over the posted speed in New Jersey a driver receives two points on their license. We see in the driver’s manual no extra penalties listed for a provisional driver but would advise your daughter to check with the NJ Motor Vehicle Commission (MVC) or the court listed on her citation for more information on her situation.

The restrictions for a driver with a provisional license include:

  • No driving between 12:01 a.m. and 5:00 a.m.
  • Passengers must be from the driver’s household, plus one additional person. If the driver is at least 21 years old, there are no passenger or hour restrictions.
  • Drivers cannot use cell phones, hand held video games or any other hand held electronic devices.
  • The driver and all passengers are required to wear seat belts under GDL law.

The NJ driver's manual notes that if a student driver commits a traffic offense, responsibility will be with both student and instructor. In addition, holders of GDL Permits or Provisional licenses may receive a $100 fine for violating any GDL conditions.

All holders of a Provisional Driver License whose provisional licensing period is NOT extended by MVC beyond the standard 12 months MUST upgrade to a Basic Driver License after the end of those 12 months. Motorists eligible for, but WHO DO NOT upgrade to, a Basic Driver License at the end of those 12 months will remain subject to MVC’s Provisional Driver License regulations and could be cited by law enforcement for violating Provisional Driver License regulations.

To get a basic license

  • You must be at least 18 years old
  • Complete the unsupervised driving period without any suspensions or postponements.
  • Go to any MVC Agency with your provisional license and other documents to pass the 6 points ID and address verification
  • Pay $24 license fee

So as long as this ticket does not result in a suspension or postponement then it would appear that your daughter would still be on track to obtain her basic NJ license after a year of holding her provisional license. You or your daughter though can check with the NJ Motor Vehicle Commission to find out for certain if this speeding citation will affect her proceeding through the graduating driver’s licensing (GDL) system.
