I've had auto insurance for the last year with the same company. The policy lapsed 8/14/2007. My car was stolen and recovered on 8/18/2007 with some damage (probably around $1500). I opened a new policy with the same insurance company on 8/23/2007. Because it lapsed, I was given a new policy number. My claim has been denied because they state I was not covered during this period. I was told by a friend that Wisconsin has a 10 day extension where you are still covered during this period. Is this true?

Unfortunately no, there is not a 10 day extension or grace period in Wisconsin for restarting your insurance policy if it had lapsed.

As the Wisconsin Insurance Commissioner states, unlike health insurance policies, auto insurance policies, do not have a required grace period. The premium is due, at the insurance company, on the date identified on the premium notice. If the premium is not received by that date the policy automatically terminates.

If your policy expired on 8/14/07 due to non-payment or cancellation due to you not renewing the policy and then you restarted with your insurance company on 8/23/07 then there would not be coverage for the dates in between. Even if your company did reinstate your policy, which you stated they did not, a claim would not normally be accepted during the period which you had the lapse in coverage.

So your claim being denied for your car being stolen during the time you were without insurance would be the normal response of an insurance carrier. Since your car was recovered with damages you will be personally responsible for paying for the repairs unless the thief was apprehended by the police. If the person who stole your vehicle was found then you may see if you will be able to take this individual to court and get a judgment for the cost of repairs.
