When driving a vehicle with a New Jersey provisional license one must observe the following requirements and restrictions:
- No driving between 12:01 a.m. and 5 a.m.
- You cannot use cell phones, hand held video games or any other hand held electronic device
- Seat belts must be worn at all times
Plus the condition of the provisional license you are referring to which is that passengers must be from your household with only one additional person from outside your household being allowed in the vehicle.
This wording from the NJ Motor Vehicle Commission (MVC) is a bit confusing it is clarified a bit where it reads in the driver's manual that a provisional license holder may only have passengers from their shared residence plus one additional person. We contacted the New Jersey MVC for further clarification and the representative stated that the holder of a provisional license is permitted to operate a passenger vehicle with just one additional passenger in the vehicle, so a household member is not required to be in the car.
So a NJ provisional license holder can drive with just one passenger, who is not a family member, whether or not a household/family member is present in the vehicle. If the provisional driver has multiple passengers in the car then only one passenger can be a non-household member, the rest of the passengers must be from their household to comply with the restriction on their license type.
Remember if that if the Provisional License holder is 21 or over, passenger and hour restrictions do not apply.
