According to the New York Department of Motor Vehicles brochure for NYS new drivers, there are certain restrictions for junior permit, limited junior license and regulator license drivers regarding the region of Long Island.
On Long Island (Nassau & Suffolk Counties) with a junior permit there are restrictions for the hours of 5 AM – 9 PM. These restrictions or conditions include that you must drive only under the immediate supervision of:
- Your Parent
- Your Guardian
- Your Person "in loco parentis"
- Your Driver Education Teacher
- Your Driving School Instructor
- Anyone who has been designated in writing by your parent, guardian or person "in loco parentis"
The person above must be at least age 21 and have a license valid for the vehicle being driven. For a junior permit holder during the hours of 9 PM to 5 AM you must NOT drive.
The next step in the NYS graduated licensing system is a limited junior license. The restrictions for 5 AM – 9 PM with the limited junior license include:
- NO Driving Alone.
- You may drive under the immediate supervision of your parent, guardian, person "in loco parentis," driver education teacher, driving school instructor, or any person designated in writing by your parent, guardian or person "in loco parentis" who is at least age 21 and have a license valid for the vehicle being driven.
During the hours of 9 PM to 5 AM with a limited junior license the same conditions apply, you must NOT drive alone and you may drive under the immediate supervision of your parent, guardian, or person "in loco parentis," who is at least age 21 and has a license valid for the vehicle being driven.
When you license converts or progresses to a regular junior license, you may drive alone, during the hours of 5 AM to 9 PM and 9 PM to 5 AM, but only directly between your home and employment, a work-study program, a course at a college, university, or registered evening high school, a driver education course, or while engaged in farm employment.
You may otherwise drive when accompanied by your licensed parent, guardian, person "in loco parentis," driver education teacher, or driving school instructor if you are not driving to one of the permitted locations listed above.
If you hold a Junior License in the counties of Nassau or Suffolk when driving alone between your home and a qualifying school course or approved work-study program, you must carry proof of enrollment. This must be a letter, dated and signed by an appropriate school or program official, on the school or program letterhead, and show the address and telephone number of the official for verification by a magistrate or police officer. The letter also must include the date(s), hour(s) and location(s) of the school course or program activity, your name, date of birth, and license identification number.
So if the school you are referring to is a class at a university, college or evening high school then it would appear with a New York junior license you could drive alone. If you are speaking of driving alone to a daytime high school then it does not appear this is allowable with your license status.
As for the penalties, the DMV does not list specific penalties for breaking your restrictions however it does mention that your junior permit, license, or privileges will be suspended for 60 days if you are convicted of committing a serious traffic violation (generally three points or more) or two other violations while you hold a junior permit or license.
Also the NYS DMV notes that your junior permit, license, or privileges will be revoked for 60 days if you are convicted of a serious violation (generally three points or more) or two other violations within the first six months after you receive your license or privileges back following a suspension or revocation.
