Yes, it is illegal to drive without insurance in Miami, Florida or anywhere else in Florida according to the FL state statutes.
If you did happen to break a law, or even worse cause an accident, and were found by law enforcement to be driving without insurance you can be cited. Motor vehicle insurance is required for a registered vehicle in FL to be on the roadway.
According to the Department of Highway Safety and Motor Vehicles they are authorized to suspend your driving privilege, including your vehicle tag and registration, for up to three years or until proof of Florida insurance is provided, whichever is first.
A reinstatement fee of $150 up to $500, for subsequent violations, must be paid and you must provide proof of current Florida insurance to reinstate your license after a suspension due to being an uninsured motorist. The penalties increase if you are in an accident that causes property and/or bodily injuries to others.
If you were to be in an accident and cause damages without insurance keep in mind that you could personally be held responsible for paying out of your pocket the cost to repair the other person's vehicle and you would have no protection for your vehicle without collision coverage.
If you did cause an accident and were without at least the minimum auto insurance that Florida requires you would have to negotiate with each person or their insurance company to satisfy the losses they incurred. Without obtaining the required FL car insurance coverages and negotiating a settlement with those you harmed in an accident the FL HSMV would be able to suspend your driver license, tags, and registration.
Even if you were not stopped by the police due to following the rules of the road and staying out of accidents, the HSMV would normally find out from your previous insurer that you cancelled your policy and see that a new policy was not started and thus you have a lapse in your insurance.
If you are currently driving without insurance in Florida it would advisable to get at least the state required property damage and PIP coverage on your vehicle as soon as possible so that you are not caught by the HSMV for a lapse in coverage or cited by law enforcement for being on the road as an uninsured motorist.
