I am from Philadelphia, Pennsylvania and have a PA permit but I recently moved to Delaware. I was wondering if I could drive in DE with my PA permit.

According to the Delaware Division of Motor Vehicles normally as a new resident of DE to continue to drive in Delaware you must apply for and receive a Delaware driver license within 60 days after becoming a Delaware resident. Since you do not have a full Pennsylvania license to turn in yet you will likely need to follow different rules.

If you are under 18 years of age, you must have completed a course in driver education, which must be approved by the Delaware Dept. of Public Instruction. Also, one parent (with whom the child resides) is required to sign your application to get a DE driver's license.

Since July 1, 1999, those drivers under 18 years of age who transfer from another state will be issued a graduated driver license unless their out-of-state license was issued for over one year, and the driver has reached at least 17 years of age.

The DE DMV also gives the following information on those persons who are at least 16 years old but less than 18 years and were issued a driver license by another state. You must obtain a Delaware license within 60 days after becoming a Delaware resident by following these instructions:

  1. The applicant must have completed an approved driver education course.
  2. The applicant must pass a written and road examination conducted by the Delaware Division of Motor Vehicles and an eye screen.
  3. The application must be signed by an approved sponsor.
  4. If the minor applicant was issued an out-of-state license for over 18 months, they may be eligible for a Class D operator's license.
  5. If the minor applicant was issued an out-of-state license for less than 12 months, they may be eligible for a Level One Learner's Permit.

Requirements for first time driver’s license applicants over the age of 18 include being issued a DE temporary instruction permit (learner’s permit). The purpose of the Delaware learner's permit is to enable you to drive the class of motor vehicle for which you want a driver’s license.

Before a learner's permit will be issued, you must pass an eye screen and written test. After you pass these tests and pay the required fee, a learner's permit is issued for 60 days. While you are learning to drive you must be accompanied by a licensed driver who is qualified to drive the class of vehicle in which you are training, and they must be at least 21 years of age.

To obtain your license, you must take a road test at the same location that issued the permit but not until 10 days after the permit was issued. If you do not pass the road test within the 60-day period, you are permitted one extension of the learner's permit for an additional 60 days, provided application is made and a second fee of $2.00 is paid before the original permit expiration date, otherwise your fee is forfeited.

So while the DE DMV did not specifically mention driving with an out of state learner's permit while it is likely you could do so for at least the first 60 days as a resident, before you are required to apply for a Delaware license or permit, you should check with the Delaware Division of Motor Vehicles to find out for certain. You will also want to find out what restrictions or conditions you will have to follow if you are allowed to drive in Delaware with the PA learner's permit.
