It would depend upon state laws whether your second ticket for driving without wearing your seat belt would be the same as the first ticket you received or a different amount.
Normally though the fine amount for a second offense would not be less, if it changes it would usually be for more money since the state makes penalties for substantial to try and keep a person from breaking the same law for a third or subsequent time.
For example in Louisiana the amount of the fine for a seat belt violation is higher if you are caught for a second time not wearing your safety belt. The penalties for LA for this violation of the law are:
- Upon conviction of first offense, the fine shall be twenty-five dollars which shall include all costs of court.
- Upon conviction of second offense, the fine shall be fifty dollars which include all costs of court.
- Upon conviction of a third offense and any subsequent offense, the fine shall be fifty dollars plus all costs of court.
They say that the difference between the penalty for a second offense and a third offense is the court costs associated with the fine. Court cost can be many times more than the fine in some areas we have read.
So keep in mind that the amount of your fine will also depend upon if you received the tickets for the seat belt violation in the same jurisdiction each time you were cited. Many times states allow individual judges or jurisdictions to determine the fine amount, court costs and other associated fees so if you received the ticket in a different area of your state the penalty amount may be different this second time.
