As of January 2008, if I am in an auto accident will my insurance cover chiropractic care? If so, will it be a chiropractor of my choice?

Yes, as with the old no-fault (PIP) system in Florida if you are in an auto accident and chiropractic care is deemed necessary then it may be covered by your auto insurer. You will need to read through the terms of your policy to see if you will be able to go to a chiropractor of your choice. No matter what though he or she will need to be licensed and certified for your PIP to cover expenses incurred from seeing a chiropractor.

The new no-fault law intends to deter fraud so it contains significant reforms, including a fee schedule to control costs of medical care. Also, services must be provided by licensed / certified physicians, dentists, chiropractors and osteopathic physicians, and treatment clinics must be owned by licensed specialists.

The new FL no-fault auto insurance legislation contains these provisions:

  • Beginning Jan. 1, Florida drivers must once again buy at least $10,000 of PIP.
  • The law includes a fee schedule limiting payments to 200 percent of Medicare's schedule for emergency transport, in-patient, out-patient and all other medical services.
  • Hospital emergency room services would be paid at 75 percent of what is billed.
  • Physicians are entitled to $5,000 of the $10,000 PIP benefits.
  • Clinics must be owned by doctors or specialists.

car insurance commentsEmergency services in most hospitals are still trying to charge the patient that additional 25% that is legally supposed to be written off per the new pip laws. So most people including hospital billing are still unclear about the 75% cap and insist on contracted adjustments. Is there any way to make it more clear so the improper billing will stop.
