I am in the military and live in Texas but have a vehicle registered in Florida. My windshield recently broke and my insurance company says that I have to pay my deductible on my comprehensive policy to have it replaced. I know Florida has a law saying I don't have to pay the deductible but my insurance company is saying since I live in Texas I will have to pay. Does this sound correct? Thanks for your help!

If you have an insurance policy in Florida, with a Florida registered insurance company then you should not have to pay your deductible for a windshield claim. If you have an insurance policy in Texas, with a Texas registered insurance company then you would be responsible for the deductible amount normally.

The basics of Florida Statute, 627.7288, states that the deductible provisions of any Florida motor vehicle insurance policy, providing comprehensive or combined additional coverage, shall not be applicable to damage to the windshield of any motor vehicle covered under such policy. 

Texas has no such state law so while some insurance companies in TX may waive the deductible for windshield repair or replacement usually your deductible would be due with a Texas insurance policy.

For further information on the Florida statute regarding the waiving of a deductible and if it should apply in your situation contact the consumer division of the FL Department of Financial Services, the insurance regulatory body for Florida.
