Each state is different, but in general the order of recovery for loss (if coverage is applicable and/or available) is as follows:
· Workers Compensation
· Personal Injury Protection (PIP)
· Medical Payment Coverage
· Liability Coverage (other party)
· Uninsured and/or Underinsured Motorist (UM or UIM)
· Health Insurance or other applicable coverage
So it will depend upon your state's insurance laws and guidelines however generally if your PIP limits have been reached it would next go to your medical payment coverage, then the at-fault party's bodily injury liability coverage.
Some individuals decide to go straight to individual health insurance. Then, the individual health insurer may subrograte against other coverages. Some will require you to file with the other insurance companies before reviewing the claim.
There are some states where the order could be different for the coverages. For example according to the Massachusetts Division of Insurance your PIP coverage pays for medical expenses in excess of $2,000 that are not reimbursed by your medical insurance only after these expenses have been submitted to the medical insurer to determine what it will and will not pay.
In MA your PIP coverage will not pay for expenses over $2,000 that your medical insurer would have paid if the injured person had sought treatment in accordance with the terms of your health plan.
