In Alabama, all motor vehicles operated on public highways must be covered by minimum liability insurance coverage.
The Minimum Liability Insurance (MLI) law requires motor vehicle owners to have liability insurance in the following minimum amounts:
- $20,000 for death or bodily injury to one person;
- $40,000 for death or bodily injury to two or more persons; and
- $10,000 for damage or destruction of property of others.
Since you are likely on the title and registration of cars in AL you should know that owners must sign a statement at the time of registration affirming that their motor vehicles are insured as required by Alabama law.
Alabama Department of Revenue's Motor Vehicle Division has a Mandatory Liability Insurance (MLI) Section. Here it states that in Alabama, driving without the mandatory liability insurance needed for a vehicle is termed a MLI violation. When you are given a citation in AL for a MLI violation and the conviction is final, the court will notify the department of revenue. This state agency will then suspend your license plate registration.
For a first time license plate registration suspension in Alabama you can immediately get it reinstated if you pay a reinstatement fee of $100 and show current proof of insurance. If it is your second or subsequent time with a registration suspension there will be a 4 month suspension in addition to a $200 reinstatement fee, plus the need for proof of insurance.
Beyond the registration suspension, any owner or operator of a vehicle convicted of a MIL violation may be fined up to $500 for the first offense. If convicted a second or subsequent time the fine may be up to $1,000 or a 6 month driver's license suspension or both.
It is difficult for us to say how or when your husband can get his license back since you stated he was driving without a license at the time of the accident. If he was driving on a suspended license then likely he will also receive penalties for this infraction of Alabama law.
Alabama Code 32-6-1 requires drivers to be licensed in Alabama. Subsection (a) states that every person, except those specifically exempted by statutory enactment, shall procure a driver's license before driving a motor vehicle upon the highways of this state.
AL Code 32-6-18 gives the penalties for driving without a valid license in Alabama. From reading this section of the Alabama law it would appear that a ticket for driving without a license in Alabama will come with a fine of around $100 plus an extra $50 fee. The amount for this citation should be within the parameters set by of the state however the exact cost of a ticket will vary from one jurisdiction to the next.
Your husband should contact the court listed on his citation(s) to see what his penalties will be and the AL MVD to see what he can do to get his license reinstated.
