My back auto glass was smashed during an attempted theft. As a long time Florida resident I was told that I had to pay this deductible, since it was not a windshield, but a back window. True?

Yes, the Florida statute that waives the deductible speaks of doing so for the front windshield and not back or side glass.

The wording of the Florida Statute, 627.7288, appears to say that the deductible is waived only for windshield glass. The basics of this statute states that the deductible provisions of any Florida motor vehicle insurance policy, providing comprehensive or combined additional coverage, shall not be applicable to damage to the windshield of any motor vehicle covered under such policy.

Current Florida statute states:

Comprehensive coverage; deductible not to apply to motor vehicle glass. The deductible provisions of any policy of motor vehicle insurance, delivered or issued in this state by an authorized insurer, providing comprehensive coverage or combined additional coverage shall not be applicable to damage to the windshield of any motor vehicle covered under such policy.

It seems that from reading the Florida Statute it would apply to only the windshield of the motor vehicle and so the deductible would not be waived, thus it would be due, for back glass smashed during an attempted theft. For further interpretation of the Florida statute that waves the glass deductible contact the insurance consumer division of the FL Department of Financial Services.
