The Indiana Department of Insurance (DOI) does not list any specific time frame in which for an insurance company to make a settlement offer, instead it wants the insurer to do so in a reasonable amount of time.
The DOI states that they do expect companies to take prompt action on claims, to fully investigate all pertinent facts concerning the claim, and make all insurance settlement offers in good faith. This government agency notes that before you contact them for assistance with your insurance problem, you should first contact the consumer affairs department of the company involved for special assistance. Usually companies are anxious to resolve problems and get a claim settled.
You can contact the Consumer Services Division of the DOI to assist you if your auto insurance claim is taking a lengthy period of time to offer a settlement offer. It is important to note however that the IN insurance regulator's office cannot evaluate the monetary value of an injury or a property claim. They will though review all requests for assistance.
If you were injured in an accident and are thinking of filing a lawsuit against the at fault party then the statute of limitations in the State of Indiana for a civil tort action is two (2) years from the date of injury.
You can discuss your claim issues with the claims adjuster working your incident and if you are not getting satisfactory information about your settlement or claim then you can contact the IN DOI to make a complaint or obtain consumer advice.
