Car Insurance Question  In the state of AK (Alaska) is a SR-22 required after getting a reckless driving ticket (10 points)?

The SR-22 financial responsibility certificate is not required after you get a reckless driving ticket but it will be if you are convicted of this major moving violation and your Alaskan driver's license is revoked.

According to the AK driver manual reckless driving is defined as a willful disregard for the safety of persons or property. Conviction of reckless driving in Alaska will result in a license revocation. You will need to find out from the court listed on your citation or the AK Division of Motor Vehicles (DMV) how long the revocation of your driver's license will last.

The driver's manual for AK goes on to note that a period of suspension or revocation will continue beyond the ending date unless you properly reinstate your driving privileges and you file proof of financial responsibility for the future.

In AK anytime your privilege to drive is suspended, revoked, or limited; you will be required to carry financial responsibility for the future after the license action is over. Proof of financial responsibility for the future is usually provided to the Division of Motor Vehicles by submitting an “SR22” insurance filing form as you mentioned. This type of insurance filing requires the insurance company to notify the Division of Motor Vehicles if your liability insurance coverage lapses or is cancelled.

As the Alaska DMV states, an SR-22 insurance policy is a certificate of insurance that shows the department proof of insurance for the future, as required by law. SR-22 is a motor vehicle liability insurance which requires the insurance company to certify coverage to the Division of Motor Vehicles, and the insurance company must notify DMV any time the policy is canceled, terminated or lapses. You do not need to own a car to buy this kind of insurance. If you do not own a car, ask your insurance company about a non-owner SR-22 policy.

An SR-22 insurance policy is normally required for reinstatement after a driver's privileges to drive have been suspended or revoked. If you are required to show proof of SR-22 insurance filing before having your driver's license reinstated, you must obtain a copy of the SR-22 insurance binder or application for the binder.

In Alaska you must carry this kind of insurance policy for three years from the ending day of any revocation except revocations for DWI and Refusal convictions. For DWI and Refusal convictions SR-22 is required for five (5) years from the ending date on a first offense, 10 years from the ending date on a second offense, 20 years from the ending date on a third offense, and for life on a fourth offense per Alaska Statute 28.20.230.

Once your license is reinstated you will need to be careful of being convicted of any other moving violations that are assessed point since in AK accumulating 12 points in 12 months or 18 points in 24 months requires the mandatory suspension or revocation of the driving privilege, regardless of the hardships involved. With already having 10 points from this one offense you could easily reach 12 points.

Remember no limited “work purpose” license is available should a suspension or revocation of the driving privilege be required.

A provisional license holder can only accumulate 6 or more points in a 12-month period or 9 or more points in a 24-month period before he or she must complete a driver improvement course approved by the DMV.

You may want to contact the AK DMV since credits may be earned for violation-free driving and/or completion of a driver improvement course. The DMV can give you more information on what traffic school courses are approved and could be used to receive these credits.

Since reckless driving is a serious offense and appears to mean that your Alaska driver's license will be revoked for a period of time your auto insurance rates will very likely go up once your insurer sees this offense and revocation on your MVR.
