According to the Maryland Motor Vehicle Administration (MVA) points are assessed after you have been convicted of a moving violation. The conviction may occur in either District Court or Circuit Court.
The MVA advises that for details about the number of points that are assessed for each type of violation, you will want to review both Maryland's laws (Maryland Annotated Code) and regulations (COMAR-Code of Maryland Regulations).
The transportation portion of the Maryland Code (Title 16), specifically 16-402, gives information on the MD points schedule. Here it states after the conviction of an individual for a violation of Title 2, Subtitle 5, 2-209, or 3-211 of the Criminal Law Article, or of the vehicle laws or regulations of this State or of any local authority, points shall be assessed against the individual as of the date of violation. The speeding offenses we saw listed here include:
- Speeding in excess of the posted speed limit by 10 miles an hour or more is 2 points.
- Speeding in excess of the posted speed limit by 30 miles an hour or more is 5 points.
- Speeding in excess of a posted speed limit of 65 miles an hour by 20 miles an hour or more is also 5 points.
