I was in an accident last year. I was driving a rental car at the time and paid the rental expenses with a Visa card and declined the CDW on the car. The Visa company had to cover the damages to the rental vehicle as I fit into their category (according to their listed norms). I did not have collision damage insurance on my existing car. Now, Visa has agreed on a settlement amount which is less that the amount cited by the rental company and as such the rental company is charging me the difference. What do I do? I thought I was well covered but the Visa company says that they cannot force the rental company to reach an agreement. Does that mean I have to pay the difference? What options do I have, cause I think it is the responsibility of the Visa company to cover the damages and I should not have to pay any difference. Kindly advise.

It sounds as if you are underinsured due to the circumstances and will end up having to pay for expenses above what your VISA credit card is willing to pay for your accident in the rental car.

While your VISA may extend you certain coverages they likely have a limit that you have reached and thus if the rental car company will not accept the settlement with VISA as a full payment they can then come after you for any other monies they are out due to the accident.

While credit cards do extend some insurance coverages if you rent a car you need to thoroughly read through what these terms are when deciding to not have personal auto insurance that extends to a rental or turning down coverages at the rental agency, such as the CDW.

We have read through the general Visa information regarding the CDW that they provide. Here it states that this coverage is subject to the terms and conditions in their Guide to Benefit. Typically a Visa Auto Rental CDW reimburses you for covered damage or theft to a rental vehicle while it is your responsibility as well as valid administrative and loss-of-use charges imposed by the auto rental company and reasonable towing charges.

There are many rules and exceptions stated in the guide to the CDW benefit such as only vehicle rental periods that neither exceed nor are intended to exceed fifteen (15) consecutive days within your country of residence or thirty-one (31) consecutive days outside your country of residence are covered.

Also the Visa benefit usually provides reimbursement up to the actual cash value of the vehicle as it was originally manufactured. Most private passenger automobiles, minivans, and sport utility vehicles are eligible, but some restrictions may apply.

Without knowing your exact situation, the specifics of your Visa's CDW benefits, etc we cannot advise you of what steps to take next. If would appear that you will be come after by the rental car agency for monies above the amount paid by VISA and thus may want to seek legal counsel on what to do.

If you can find out more information on why the rental car agency will not accept Visa's settlement amount as full payment it would likely be helpful to any lawyer you contact about taking your case.
