It will depend upon what insurance coverages you have placed on your 2008 vehicle. If you have placed physical damage coverages of collision and comprehensive then your car is protected by your insurance policy. Thus if you are at fault in an accident your liability coverages would cover those that you caused damage to and your own collision coverage would cover your own vehicle.
If you decided not to place collision coverage on your vehicle, since it was paid off and you did not have a lien holder requiring you to add this coverage, and thus only had liability coverages then you would not have any coverage on your vehicle and thus could not make a claim.
Collision coverage covers damage to your car when your car hits, or is hit by, another vehicle, or other object. Pays to fix your vehicle less the deductible you choose. To keep your premiums low, select as large a deductible as you feel comfortable paying out of pocket.
Comprehensive coverage covers your vehicle, and sometimes other vehicles you may be driving for losses resulting from incidents other than collision. For example, comprehensive insurance covers damage to your car if it is stolen; or damaged by flood, fire, or animals. Pays to fix your vehicle less the deductible you choose. To keep your premiums low, select as high a deductible as you feel comfortable paying out of pocket.
Most motorists that have a newer car will want to protect their asset, the vehicle, by placing both collision and comprehensive coverages on the vehicle. Even if the car is paid for in full and you are not required by anyone to have these optional coverages on the car you will want to in order to have it protected. Those with a loan or lease on a vehicle normally will be required to have both collision and comprehensive coverages on their car. If a person owns more than what a car is worth they would also want to get GAP insurance that would cover the "gap" or balance between what the car is worth and what they owe on the car.
If you are unsure of what coverages you have on your policy, state minimum liability coverages or full coverage with comp and collision, than read through your policy and speak with your agent. If you do have collision coverage then you could place a first party claim with your insurer for the damages your car sustained in an at-fault accident.
