I received a Prayer for Judgment in North Carolina in 2006 that supposedly would not effect my insurance premiums. However, in 2007, I moved to South Carolina and am now, today, finding out that upon my insurance renewal the violation is listed on my DMV record and is affecting my insurance premium. Is the PJC law different in SC?

Yes, to the best of our knowledge in South Carolina there is no PJC available for moving violations or traffic tickets though we believe there is a type of prayer for judgment continued allowed for some criminal offenses in SC. While NC has the PJC and other states allow for supervision or probation (such as not receiving another moving violation for a year) to take care of minor moving violations SC generally does not allow these types of ways to "get rid" of a ticket.

As you are likely aware in North Carolina Prayer for Judgment Continued (PJC) is a finding of guilt without entry of a judgment. A PJC is usually obtained after a plea of guilty in court but sometimes a judge can enter a PJC after a not guilty plea.

According to NC sources for Automobile Insurance purposes, one can have up to one PJC per household every 3 years that will not allow insurance premiums to be raised. For Driver's License purposes, a driver can have up to two PJCs within a 5 year period which will not result in driver's license points.

However if you move out of state and the offense which is related to the PJC is on your NC driving record, or if your new state of South Carolina has transferred over your North Carolina driving record then moving violation you took care of with a PJC is listed there, then your SC insurer could see it and rate on it. The NC information on obtaining a PJC for insurance purposes is good in North Carolina but that law does not extend to insurance companies out of state.

Since in NC a PJC is a judgment is entered against you (you are found guilty or responsible), but the judgment is "continued" (delayed) if you comply with the conditions of the order then this judgment would normally be seen on your NC MVR. You may want to get a copy of your driving record to verify. You can ask the NC DOT how the PJC is supposed to be placed on your driver's history and if you find out that with a PJC the traffic offense is not supposed to be listed on your ticket at all, like a dismissed ticket instead of one with no judgment entered, then you can ask why the SC insurance company is able to see and rate on it.
