I was in a car accident that was my fault and my car has to be totaled. Do I have to pay a deductible to the insurance company if my car was paid for and I didn't have a car payment?

Yes, your deductible for your collision coverage would be due whether your car is paid off or not.

A deductible is required when you use your physical damage coverages of either collision or comprehensive. A deductible is the amount of the loss which you, the insured, agree to pay for if you file a claim under these coverages. Typically, the insured is responsible to pay their deductible before benefits from the insurance company are payable.

The deductible amount is chosen by the insured at the inception of their policy. If you choose a higher deductible it should lower your premium. It is wise to not pick a deductible amount higher than what you can afford to pay out if it is needed.

When you use your coverages that have a deductible attached to them you will owe a deductible whether you own your car in the free in clear or have a lease or loan which you are making payments on.
