Car Insurance Question  How much is a second seat belt fine in Moreno Valley, CA?

Likely you were cited for driving without a seat belt under 27315(d)(e) of the Vehicle Code which states the mandatory use of safety belts is required. Subsection h of this part of the California Vehicle Code states:

(h) Any violation of subdivision (d), (e), or (f) is an infraction punishable by a fine of not more than twenty dollars ($20) for a first offense, and a fine of not more than fifty dollars ($50) for each subsequent offense. In lieu of the fine and any penalty assessment or court costs, the court may order that a person convicted of a first offense attend a school for traffic violators or any other court-approved program in which the proper use of safety belts is demonstrated.

The fine listed for a ticket for the 27315 offense on the Uniform Bail Schedule is $76.00. This is for a first offense so as you can tell the $20 penalty grows a bit when you add on court costs, county fees, etc. A second offense would then likely be around $100, but again will depend upon the county which you received the ticket and thus you should call the traffic court of the county that Moreno Valley, CA is in to get information.

If instead you were cited for a child not having on their seat belt then the find is much higher. According to the CA Uniform Bail and Penalties Schedule for 2007, the usual fine for this child safety belt offense is $380 however the jurisdiction in which you received the ticket can add on more court costs, etc.

Section 27360.5 of the California Vehicle Code is titled - Child Passenger Restraint System: Safety Belts: Requirements: Fines

Here under subsection (a), which is what you were cited for, it states that no parent or legal guardian, when present in a motor vehicle, as defined in Section 27315, may permit his or her child or ward who is six years of age or older, but less than 16 years of age, or who is less than six years of age and weighs 60 pounds or more to be transported upon a highway in the motor vehicle without properly securing the child or ward in an appropriate child passenger restraint system or safety belt meeting applicable federal motor vehicle safety standards.

Subsection (c) (1) it in part states that a first offense under this section is punishable by a fine of one hundred dollars ($100). Part (2) states that a second or subsequent offense under this section is punishable by a fine of two hundred fifty dollars ($250).

Since the base fine for a second offense goes starts at $250, compare to $100 for a first offense, that plus the court costs and other fees the jurisdiction can push the cost of the ticket much higher again, as the uniform bail schedule shows since they list the normal find amount for a first offense as $380.
