Car Insurance Question  I have a New York CDL and I received a big speeding ticket in New Jersey. Will I get points in NY if I plead guilty on this?

As you are likely aware both New York and New Jersey are members of the Drivers License Compact (DLC) so the New Jersey courts will inform the NYS Department of Motor Vehicles (DMV) of this speeding offense once you are convicted of it.

To the best of our knowledge you would not receive points on your commercial driver's license (CDL) in New York for an out of state, New Jersey, speeding ticket however we would advise you to check with the NYS DMV to find out for certain.

The NYS DMV site states that they do not record out-of-state violations committed by NYS drivers in other jurisdictions, with a few exceptions. The exceptions are alcohol-related violations, drug-related violations, and moving violations committed in Quebec or Ontario. Under special agreements, traffic convictions in Quebec or Ontario are recorded on NYS driver license records and carry points. Except for violations in Ontario and Quebec, points are not added to your New York license for out-of-state violations.

As a CDL holder though you are under some different rules, including federal laws. One such federal law is that you must notify NYS DMV, since it is your home state licensing agency, within 30 days if you are convicted in any other jurisdiction of any traffic violation (except parking). This is true no matter what type of vehicle you were driving.

Since CDL holders have stricter rules regarding their license it is likely that your NJ violation will be placed on your driving record in NYS driving record to track your violations nationwide since with a CDL you will have your license suspended if you are convicted of too many traffic violations.

The New York State CDL handbook states that you will lose your CDL for at least 60 days if you have committed two serious traffic violations within a three-year period involving a CMV. You can lose your CDL for at least 120 days for three serious traffic violations within a three-year period involving a CMV.

Serious traffic violations include:

  • Excessive speeding (15 mph or more above the posted limit)
  • Reckless driving
  • Improper or erratic lane changes
  • Following a vehicle too closely
  • Traffic offenses committed in a CMV in connection with fatal traffic accidents
  • Operating a CMV without first obtaining a CDL
  • Operating a CMV without a CDL in the driver’s possession
  • Operating a CMV without the proper class of CDL and/or endorsement for the specific vehicle being operated or for the passengers or type of cargo being transported
