If you are cited and convicted of a moving violation / traffic offense in British Columbia, another Canadian province or in certain states within the United States then yes, you can receive demerit points on your driving record in Quebec.
The SAAQ states that an equivalent traffic offense committed in another province or in an American state with which Québec has a reciprocal agreement results in demerit points as if the offence occurred in Québec.
In Quebec demerit points are entered on the record of drivers who commit certain offenses:
- Under the highway safety code, or
- Under a municipal by-law provincial or federal statute or regulation concerning road safety.
Criminal offences, hit and run, dangerous driving, driving while impaired, etc, committed in another province will be entered on the Quebecer’s driving record. The same is true of an equivalent offence committed in an American state with which Québec has a reciprocal agreement; the breach carries the same penalty as if it had occurred in Québec.
We found in the Quebec Highway Safety Code Regulations that this Canadian province has reciprocal agreements with the some States such as New York and Florida regarding traffic violations. There is also a reciprocal agreement between the government of Quebec and the State of Maine concerning driver's licenses and traffic offenses.
Demerit points entered on a person's file remain there for two years following the date of conviction or payment of the corresponding fine. It should be remembered that no notice is sent out when demerit points are written off your record.
As for how traffic convictions affect your auto insurance rates, the amount of the insurance contribution included in your driver’s license fees funds the public plan administered by the SAAQ and depends on the number of demerit points entered on your driving record during the reference period.
So if you receive a ticket and are convicted of that traffic violation in British Columbia or another Canadian province then you will receive demerit points on your driving record in Quebec. Also if you are convicted of moving violations in certain states in the US you can also receive demerit points.
