According to the Oregon Department of Transportation (DOT), license requirements for motorcycles and mopeds differ. To operate a motorcycle in Oregon, you must have a motorcycle endorsement on your driver license. You may operate a moped with any class of driver license, or a Class C restricted license, which limits you to moped operation only.
Applicants under 21 years of age are required to complete a TEAM Oregon Basic Rider Training course to become eligible for a motorcycle endorsement. If you are less than 18 years old, you must have a parent or legal guardian’s signature on all applications unless you are emancipated or married.
It will depend upon which offense you are cited for in regards to driving without a motorcycle or moped license/endorsement.
If you were cited under Oregon Revised Code 807.010 which is titled operating vehicle without driving privileges or in violation of license restrictions then this would be a Class B traffic infraction. This part of OR law reads;
(1) A person commits the offense of vehicle operating without driving privileges if the person operates a motor vehicle upon a highway or premises open to the public in this state and the person does not have an appropriate grant of driving privileges from this state in the form of a license, driver permit, endorsement or statutory grant of driving privileges allowing the person to engage in the particular type of operation. The offense described in subsection (1) of this section, vehicle operating without driving privileges, is a Class B traffic violation. From what we have read this type of offense comes with a fine of around $170. This is likely a base fine with other fees or assessments.
Or perhaps you would be written up under ORS 807.570 for failure to carry or present license. Here the statute states:
(1) A person commits the offense of failure to carry a license or to present a license to a police officer if the person either: (a) Drives any motor vehicle upon a highway in this state without a license, driver permit or out-of-state license in the person’s possession; or (b) Does not present and deliver such license or permit to a police officer when requested by the police officer under any of the following circumstances: (A) Upon being lawfully stopped or detained when driving a vehicle. (B) When the vehicle that the person was driving is involved in an accident.
The offense described in this section, failure to carry a license or to present a license to a police officer, is a Class C misdemeanor which carries a maximum penalty of 30 days in jail and a fine of $1,250.
Oregon’s insurance law requires every driver to insure their vehicle, including a motorcycle or moped, if it is operated on any highway or on premises open to the public. The minimum amount of liability insurance required is:
Bodily injury and property damage liability in the amounts of $25,000 per person; $50,000 per accident for bodily injury to others; and $10,000 per accident for damage to property of others. This is referred to as 25/50/10.
Uninsured motorist coverage in the amounts of $25,000 per person, $50,000 per accident for bodily injury (25/50).
