Car Insurance Question  I just got a ticket for a "fail to yield right of way from stop sign" in Nevada I live in Arizona. It is my first ticket in over 10 yrs how many points is it and will it affect my insurance?

Nevada and your home state of Arizona are both members of the Drivers License Compact. This Compact requires member state to report back to the state in which a driver is licensed any conviction of traffic tickets. So the AZ Department of Transportation should be notified by the NV courts or DMV about this traffic ticket you received if you are convicted of it. Normally if you pay the fine associated with the ticket you are convicted of the offense.

Chapter 6, Article 3 of Title 28 within the Transportation section of Arizona statutes, gives details on the DLC and Arizona's participation. It does not note however if points for out of state offenses will be assigned points or if the offense will be recorded onto your driving record.

To seek clarification we contacted AZ DOT Motor Vehicle Division and their reply was that they are indeed informed of out of state moving violation convictions and once they receive in this information from another state the conviction goes on your Arizona driving record. The AZ MVD representative also stated that points would be assessed for out of state tickets.

From the AZ points list on the MVD site it appears that you will get 2 points on your driving record for your Nevada failure to yield ticket. That is unless you were in an accident and people were seriously injured or killed. Failure to stop for a traffic signal, stop sign or to yield the right-of-way, causing death is 6 points in Arizona and the same offense with causing serious injury instead of death is 4 points.

Since the Nevada ticket conviction will be placed on your Arizona motor vehicle record (MVR) your insurance company will be able to see it the next time they pull your driving record. It then will be up to the rating system of your insurance provider to determine if your rates will go up due to this one ticket. Since it is your only ticket in the last 10 years they may not raise your rates however you may lose a good driver discount.

You may see if Nevada has a traffic school option or another way in which to keep the ticket from being reported to Arizona and placed on your driving record. If however it is placed on your MVR you should discuss with your insurance agent your specific insurance carrier's rating system and how this violation may affect your rates.
