We will assume you are in Virginia since that is where the term FR-44 is used. According to the Virginia Department of Motor Vehicles (DMV) effective January 1, 2008 Virginia law requires persons convicted of certain DUI and other serious violations detailed in the Code of Virginia 18.2-51.4, 18.2-266 and 18.2-272 to purchase an insurance policy with liability coverage at least double the minimum Virginia limits. Therefore, the insured's liability limits must be at least $50,000 for injury or death to one person, $100,000 for injury or death of two or more people, and $40,000 for property damage (50/100/40).
The VA DMV lists specifically that FR-44 certification is required on or after January 1, 2008 for the following convictions:
- Maiming while under the influence
- Driving while under the influence of intoxicants or drugs
- Driving while the driver's license has been forfeited for a conviction, or finding of not innocent in the case of a juvenile
- Violation of the provisions of any federal law or law of any other state or any valid local ordinance similar to the above
So if your alcohol related conviction falls into this section of VA law, which it likely does, then yes you would need to carry the FR-44, even if you had liability insurance in place at the time of the accident. You mentioned you had $10,000 of liability coverage on your motorcycle but the minimum limits in Virginia are more than that.
Virginia law requires the following minimum insurance coverage for all registered vehicles in the following amounts:
- Bodily injury/death of one person $25,000
- Bodily injury/death of two or more persons $50,000
- Property damage $20,000
This is referred to as 25/50/20. If you register your vehicle in Virginia and it is not covered by liability insurance, you face a $500 penalty and suspension of your driver’s license and vehicle registration(s), plus higher insurance premiums for the next three years.
To find out for certain if you are required to file the FR-44 and carry these higher auto insurance limits then check with the court in which you were convicted of the DUI on the motorcycle and/or the VA DMV. The Virginia DMV should be able to tell you if the FR-44 is a requirement for you to be able to reinstate your driver's license.
