I received a speeding ticket in New York State on Interstate 90 for 86 mph in a 65 mph zone the cop would not say what the fine will be can you tell me? Also what about the $300 driver assessment fee I have heard about? I have an Ontario licence.

From the fine schedule we have seen for New York State the amount for being caught driving 21 mph over the speed limit is a minimum of $180 and a maximum of $300. We also saw listed a possibility of up to 15 days in jail listed as a penalty for this type of speeding offense. There also may be court costs and other fees added onto a moving violation that makes it more than just the fine schedule amount we listed above. Since the total cost of a ticket can vary by location you should contact the court listed on your NYS citation to find out your fine amount and penalties associated with this moving violation.

In NYS fines increase if your are convicted of more than one speed violation in 18 months. License is revoked for 3 convictions in 18 months. Fines may vary for speeding in school zone or restricted highway. Fines are doubled in work zones.

Being convicted of going between 21 and 30 mph over the posted speed limit in New York also comes with 6 points being assigned to your driving record in NY. In addition to the fines and penalties shown, you will have to pay a state surcharge and possibly a Driver Responsibility Assessment if you receive six or more points on your driver record during a period of 18 months and the violations.

The NYS Vehicle and Traffic Law requires drivers who are convicted of specific traffic violations to pay an assessment to the DMV. The Driver Responsibility Program applies to all drivers who operate, or operated, a motor vehicle in the State of New York, regardless of the state the motorist is licensed in. The NYS Department of Motor Vehicles (DMV) notes that the purpose of the Driver Responsibility Program is to prevent the repeated behavior of problem drivers and to improve traffic.

The NYS DMV states that the in addition to any fines, fees, penalties, or surcharges that you pay for certain traffic convictions (or if you have reached 6 or more points in an 18 month period), you must pay the driver responsibility assessment. The assessment is an amount that you must pay each year for three years. You pay the assessment to the DMV.

It is stated that the driver responsibility assessments apply to incidents that occur in NYS. The assessments apply whether you have a driver license issued by NYS or any other jurisdiction, or you have no driver license at all

It would appear that unless you can get your speeding ticket reduced so that you are not assessed 6 points, you will be required to pay New York a driver responsibility fee for 3 years. The NYS DMV should send a statement to you if you are required to pay this fee. The statement will display the information that you will need to pay the assessment.

For motorists who have reached 6 points the annual assessment is $100. The minimum amount that you must pay each year is the annual assessment. The total assessment for the three years is $300. If you have received other previous tickets in NY and your points total in the last 18 months there is higher than 6 than your annual assessment would be more. The annual assessment is $25 for each point more than the original six points. So the total assessment for the three years is $75 for each point more than the original six points.

As you are likely aware New York and Ontario, Canada have a reciprocal agreement so your home licensing agency, the Ministry of Transportation (MTO), will be notified if you are convicted of the NYS speeding offense.

According to the Ontario Ministry of Transportation drivers licensed in Ontario that are convicted of a driving related offence in the State of New York you will have home jurisdictional penalties such as demerit points and/or suspensions applied to their Ontario driver record as if the offence occurred in Ontario. So you will also get demerit points on your Ontario license by the MTO for the New York speeding citation.

Since your insurance company will see this NYS speeding ticket on your driving record it could affect your Canadian auto insurance. You should speak with your insurance agent to find out if according to your insurer's rating system this one ticket will affect your rates or if this ticket will not affect you but subsequent tickets might.
