What happens when someone has no insurance and gets cited for it and then the car they were driving is no longer drivable? Are they still required to have insurance since they do not have a vehicle to insure?

If you are mandated by the state to be financially responsible by carrying auto insurance, typically through obtaining and maintaining a SR-22, than you will need to do so whether you have a car to insure or not.

If your vehicle is inoperable and you have taken off its registration and you have no other vehicle in which to insure than you would still need to carry the mandated insurance, SR-22 financial responsibility certificate, and can do so with a non-owners policy.

A non-owners SR-22 generally allows the named insure to drive any vehicle that they are given permission to drive by the vehicle owner, unless the vehicle is owned by a household member. The different between a normal SR-22 and a Non-Owners SR-22 is that with a Non-Owners SR-22 policy you do not own a vehicle to directly insure. While with a SR-22 policy you own a vehicle in which the insurance is put on.

A non-owner policy does not cover you in any vehicle you drive. Each state is different, but as a general rule it will not cover you for a vehicle registered to you, one in your household, or a vehicle provided for your regular and frequent use. If you have a vehicle registered to you, one in your household, or someone provides a vehicle for your regular and frequent use, you should NOT purchase a non-owner policy for coverage. You should get a non-owners SR22 only if you do not own a car or have access to a car which you could place a SR-22 on.

Currently, we only offer a non-owners SR22 online in Florida. You will need to call our sales center to see if we can accommodate you in other states if you want this type of coverage. During your quote process you will be asked if you need an SR22 on the driver screen. You will be asked if it is a non-owner policy on the vehicle screen.

Please be aware that CarInsurance.com offers its products in certain states. In some states you are redirected to a partner that may not offer these options. Where we are able to offer non-owners insurance the vehicle screen has this option to select a non-owners policy: "Check this box if you do not own a vehicle and would like to purchase a non-owners policy."

We hope to shortly offer online non-owner SR-22s in the states listed below, call our sales center to see if they can accommodate you now:

  • Georgia
  • Tennessee
  • Louisiana
  • Kentucky
  • Mississippi
  • North Carolina
  • South Carolina
  • Arkansas
  • Virginia
  • Texas
  • Missouri
  • Illinois
  • Kentucky

If your state is not requiring you to carry a SR-22 for a certain amount of time (typically 3 years) but just required you to purchase insurance on your car since you were cited previously for driving without insurance than likely you could take insurance off your inoperable vehicle. We would advise you though to contact your state's Department of Motor Vehicles though and find out what steps you must take before taking insurance off the vehicle.

In most states if you want to drop insurance from a vehicle (and are not required to carry the SR-22) than you can do so if you are not driving it but you must also turn in the vehicle's license plates and registration to the DMV. If you do not turn in the tags and registration than you can be found to have a lapse in insurance and be penalized with fines, suspension of registration and your driver's license.
