According to the New Jersey Motor Vehicle Commission (MVC) you must observe the following requirements and restrictions while driving with a provisional license:
- No driving between 12:01 a.m. and 5 a.m.
- Passengers must be from your household. Only one additional person from outside your household is allowed in the vehicle
- You can't use cell phones, hand held video games or any other hand held electronic device
- Seat belts must be worn at all times
A NJ provisional license holder can drive with just one passenger, who is not a family member, whether or not a household/family member is present in the vehicle. If the provisional driver has multiple passengers in the car then only one passenger can be a non-household member, the rest of the passengers must be from their household to comply with the restriction on their license type.
So you should be able to drive with one friend and your brother both in the car at the same time as long as your brother is a household member.
Make sure to follow the restrictions placed on you by the state while you carry a provisional license since according to the New Jersey Driver's Manual holders of GDL Permits or Provisional licenses may receive a $100 fine for violating any GDL conditions.
